UK CMA declares Google's strategic market status over online search dominance

The United Kingdom’s Competition and Markets Authority (CMA) has formally designated Google as holding "strategic market status" (SMS) in the online search and search advertising market. This designation, announced on Friday, marks a significant step under the new digital markets regime introduced in January and opens the door to stricter regulatory measures aimed at fostering fair competition.

The CMA’s decision highlights Google’s entrenched dominance in the digital search ecosystem. "Google has had an unparalleled position in this digital activity for an extended period", the CMA said in its ruling. "Other traditional general search providers are significantly smaller than Google and have been for many years. Bing is the largest of these providers, but its current shares of queries and search advertising are both less than 5%. No traditional general search providers have materially grown relative to Google for at least fifteen years."

New Scope of Oversight

The designation allows the CMA to impose binding rules on Google as part of its efforts to curb monopolistic practices within strategically vital digital sectors. Specifically, the ruling applies to Google’s core search services, search advertising, and AI-related tools such as AI Overviews and AI Mode, which use artificial intelligence to generate summaries and contextual responses in search results. It also includes Google’s Discover feed, "Top Stories", and News tabs within Search.

However, the CMA clarified that the designation does not extend to the Google News app, the Google News website, or search syndication services. The regulator also alluded to ongoing surveillance of new AI tools like Google’s Gemini AI assistant, suggesting these features could be reviewed as the AI search market evolves.

Potential Regulatory Measures

Though the designation itself does not directly impose new obligations, it provides the CMA with the authority to introduce specific rules aimed at enhancing competition. Some prospective measures under consideration include:

  • Giving users the ability to easily select and switch default search engines through "choice screens."
  • Strengthening data portability regulations to minimize user lock-in.
  • Ensuring that third-party content and publishers are not disadvantaged through unfair ranking or attribution practices.
  • Requiring explicit user consent for data usage in AI-generated search results.

The CMA plans to launch consultations later this year to determine the exact regulations to be implemented.

A Decade of Dominance

The decision follows a nine-month investigation into Google’s dominance, launched after the CMA’s new competition framework came into effect. The probe sought to assess whether Google’s control of over 90% of the U.K. search market has stifled innovation, hindered rival growth, or disrupted competition in the advertising sector.

This market share has granted Google unparalleled access to user data and advertising revenue for more than a decade, regulators argue. Concerns have also been raised about how Google’s services may prioritize its own products in search results while hindering competitors’ growth.

Google Responds

In response to the CMA’s announcement, Google expressed concerns about the potential impact of overregulation on innovation and business operations. "The UK enjoys access to the latest products and services before other countries because it has so far avoided costly restrictions on popular services such as Search", the company said in a blog post.

Google warned that proposed regulations could lead to delays in the rollout of new AI-driven features and increase costs for businesses relying on its advertising platform. "Retaining this position means avoiding unduly onerous regulations and learning from the negative results seen in other jurisdictions, which have cost businesses an estimated €114 billion", it added, referencing the economic fallout of regulatory fragmentation across the European Union.

The company also cautioned that interventions could harm economic growth and innovation. "Many of the ideas for interventions would inhibit U.K. innovation and growth, potentially slowing product launches at a time of profound AI-based innovation. Others pose direct harm to businesses, with some warning they may be forced to raise prices for customers", it said.

Balancing Innovation and Oversight

The CMA’s move underscores the U.K.’s growing commitment to curbing the power of Big Tech firms while striving to maintain a balance between oversight and technological progress. Companies designated with SMS status under the new regulatory framework can face legally binding rules promoting competition and transparency, with penalties of up to 10% of global turnover for non-compliance.

While Google is the first company to receive this designation, analysts expect other major tech platforms may follow as the CMA continues to scrutinize the digital economy. The regulator emphasized its intention to engage with stakeholders, including Google, before implementing formal remedies.

As the digital landscape evolves, particularly with the rise of AI, regulators remain vigilant about ensuring that the dominance of leading tech firms does not stifle competition. For now, the CMA’s action represents a pivotal moment in the global effort to rein in the influence of Silicon Valley giants while safeguarding innovation.
